Overview

Welcome to Radiance at Fluhme. In these Terms, "we," "us," and "our" mean Radiance at Fluhme, located at 3037 Washington Pike, Bridgeville, PA 15017. "You" means anyone who visits this website or receives care at our practice.

These Terms cover two things: your use of radianceatfluhme.com, and the policies that apply when you book and receive treatment with us.

Please read them. They include important information about your rights, about what this website is and is not, and about limits on our liability.

By using this website or booking an appointment, you agree to these Terms. If you do not agree, please do not use the website.

1. This website is information, not medical advice

Everything on this site is general information about aesthetic treatments. It is not medical advice, and it is not a substitute for a consultation with a qualified provider.

Reading this website does not create a physician-patient or provider-patient relationship. That relationship begins when you come in, we evaluate you in person, and you sign an informed consent form.

Do not use this website to diagnose yourself, to decide whether a treatment is right for you, or to delay care. If you have a medical emergency, call 911.

2. Results are individual

Aesthetic outcomes vary from person to person. Photographs, testimonials, and treatment descriptions on this site show results some patients have experienced. They are not a promise or guarantee of what you will experience.

Your results depend on your skin, your anatomy, your health history, how your body responds, and how closely you follow pre-care and aftercare instructions. Your provider will discuss what is realistic for you at your consultation.

3. Nothing is sold through this website

We do not sell products or services through this website. There is no online checkout.

Skincare products are available for purchase in person at our Bridgeville location. Appointments are booked through Vagaro, and payment is taken at the time of service. Memberships are managed through RepeatMD.

4. Who may use this site and our services

You must be at least 18 to use this website. If you allow a minor in your care to use it on a device you own or manage, you are responsible for their use.

Patients under 18 must have a parent or legal guardian present for the entire appointment. Some treatments are not offered to minors at all.

5. Appointments and consultations

Many treatments require a complimentary consultation first, particularly for new patients and for procedures including CoolSculpting and laser treatments. Consultations carry no obligation.

A credit card must be on file to book an appointment.

6. Cancellations, no-shows, and late arrivals

Cancellations. Cancel 24 or more hours before your appointment at no charge. Cancellations inside 24 hours are charged a $50 fee to the card on file.

No-shows. Missing an appointment without notice is charged a $50 fee to the card on file. Repeated no-shows may mean we ask for prepayment or limit future booking.

Late arrivals. Please arrive 10 to 15 minutes early. If numbing cream is part of your treatment, arrive 30 minutes early. Arriving 15 or more minutes late may mean we reschedule you or shorten your treatment time. You remain responsible for payment either way.

7. Payment

Payment is due at the time of service. We accept cash, major credit cards, and HSA and FSA cards.

Prices, promotions, and package pricing change from time to time. The price that applies is the price in effect on the day of your service. Prices posted on this website may differ from in-office pricing, and we may correct pricing errors at any time.

8. Refunds, packages, and memberships

Services. Services are non-refundable once performed. If you are not satisfied, contact us within 14 days and we will schedule a follow-up assessment.

Products. Unopened products may be returned within 14 days for store credit only.

Prepaid treatment packages. Non-refundable. Packages are transferable to another person.

VIP memberships. Memberships require a three-month minimum commitment and are non-refundable during that period. After three months you may cancel with 30 days' written notice.

9. Informed consent and medical disclosure

Prior to any treatment, each patient must review and execute an informed consent form describing the procedure, associated risks, anticipated results, and post-treatment care. Patients are encouraged to review the form carefully and to direct any questions to their provider before signing.

You are responsible for giving us complete and accurate information about your medical conditions, allergies, medications, supplements, prior treatments, and whether you are pregnant or nursing. Withholding this information can make treatment unsafe. If anything changes between visits, tell us.

You are responsible for following pre-care and aftercare instructions. Arriving with clean skin is required for most treatments.

10. Photography

We may take before and after photographs as part of your medical record. Using any photograph of you in marketing requires your separate written consent, which you may decline or withdraw. Photographs are stored securely and handled in line with HIPAA.

11. Text messages and other communications

With your consent we contact you by phone, email, text message, and mail about appointments, care instructions, account matters, and practice news.

Consent. By giving us your mobile number and opting in, you confirm that you are the owner or an authorized user of that number, and you consent to receive recurring automated text messages from us. Consent to marketing texts is never a condition of receiving care or of any purchase. Message frequency varies. Expect roughly one to five messages per week.

Costs. Message and data rates may apply. Check with your mobile carrier.

Stopping messages. You may withdraw consent at any time by any reasonable means. Replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text works. So does calling us, emailing us, replying with different words, or telling a staff member in person. We are not permitted to require one specific word or channel, and we will not. We will honor your request within ten business days and usually much sooner.

We may send a single message confirming your request. If you opt out in reply to an appointment or care message, we will stop all non-emergency texts and calls, including marketing. If you opt out in reply to a marketing message, we may continue sending appointment and care messages unless you ask us to stop those as well.

Help. Reply HELP to any text, or call (412) 886-5382.

Eligibility. You must be 18 or older and have a wireless device capable of two-way messaging. Not all carriers support this service.

Phone numbers you do not own. If you give us a number you do not own or are not authorized to use, or if you change your number and do not tell us, you agree to hold us harmless from claims arising out of messages sent to that number, including claims under the Telephone Consumer Protection Act or any state equivalent.

Text messaging is not a secure channel for protected health information and should not be used to transmit it. Please direct any communication regarding your medical history or treatment to our office by telephone or in person

12. Privacy and health information

Your protected health information is handled in accordance with HIPAA and our HIPAA Notice of Privacy Practices. Our Privacy Policy explains how we handle information collected through this website. We do not sell your personal information.

This website is hosted by Shopify. Shopify collects and processes information about your visit in order to run the site. Information you submit here may be transmitted to Shopify and to service providers who may be located outside your state or country. Shopify's privacy policy for site visitors is at shopify.com/legal/privacy.

13. Third-party services

This site links to and embeds services operated by other companies, including Vagaro for booking, RepeatMD for memberships, and Instagram. We do not control those services and are not responsible for their content, availability, security, or practices. Your use of them is governed by their terms, not ours. Direct questions or complaints about a third-party service to that company.

We may add new tools and features to the site over time. Those become part of the site and are covered by these Terms.

14. Relationship with Shopify

Radiance at Fluhme is powered by Shopify, which enables us to provide this website to you. Any transaction you enter into with us is directly with Radiance at Fluhme. By using this site you acknowledge that Shopify is not responsible for any aspect of the relationship between you and Radiance at Fluhme, including any injury, damage, or loss arising from products or services you receive from us. You release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your transactions with Radiance at Fluhme.

15. Our content

The text, images, video, graphics, logos, and design on this site are owned by Radiance at Fluhme or our licensors and are protected by copyright, trademark, and other laws. Some device names and marks, including DENSITY, Edge ONE, EdgePolish, and Sylfirm X, belong to their respective manufacturers and are used with permission.

You may view and use this site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, modify, or create derivative works from any of it without our written permission. Nothing here grants you a license to any trademark or other intellectual property.

Linking to this site. You may link to our home page from another website without asking, provided the link does not suggest that we endorse, sponsor, or are affiliated with that site, does not damage our reputation, and does not display our pages inside a frame on your site. We may ask you to remove a link at any time and you agree to do so. Any other use of our name, logo, or content on another site needs our written permission.

16. Reviews, feedback, and anything you send us

By submitting reviews, testimonials, suggestions, photographs, or other content, you grant Radiance at Fluhme a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display such content in any medium, including for commercial and marketing purposes.

You represent and warrant that you hold all necessary rights in the content, that it is accurate, that it does not infringe or violate the rights of any third party, and that you have disclosed any compensation or incentive received in connection with its submission.

We assume no obligation to maintain submitted content in confidence, to provide compensation, or to respond. We reserve the right, without obligation, to remove any content we determine to be unlawful, misleading, abusive, or otherwise objectionable.

Patients should not include protected health information in public reviews or social media submissions. Communications regarding treatment should be directed to our office by telephone or in person.

This site may occasionally contain typographical errors, inaccuracies, or out-of-date information about treatments, pricing, promotions, or availability. We may correct those and update information at any time without notice.

18. Things you may not do

You may use this site for lawful purposes only. You may not:

• Use it for any unlawful or malicious purpose, or to violate any law or regulation

• Infringe our intellectual property rights or anyone else's

• Harass, abuse, threaten, defame, or harm our staff or any other person

• Transmit false or misleading information, or impersonate anyone

• Send spam, chain letters, or unsolicited promotional material

• Upload viruses or malicious code

• Scrape, crawl, spider, or harvest data, or collect other people's personal information

• Interfere with or circumvent the site's security features

• Do anything that restricts anyone else's use of the site or exposes us or Shopify to liability

We may block or restrict access at any time if we believe you have violated these Terms.

19. Disclaimer of warranties

THIS WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ITS CONTENT IS ACCURATE, COMPLETE, OR CURRENT. ANY RELIANCE YOU PLACE ON INFORMATION ON THIS SITE IS AT YOUR OWN RISK. SOME STATES DO NOT ALLOW CERTAIN DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

20. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RADIANCE AT FLUHME AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS, ARISING OUT OF OR RELATED TO YOUR USE OF THIS WEBSITE OR YOUR RELIANCE ON ITS CONTENT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

This section applies to this website only. Nothing in these Terms limits, waives, or releases any liability for the professional medical and aesthetic services we provide, for personal injury, or for anything else that cannot be limited under Pennsylvania law. Care you receive at our practice is governed by your informed consent documents and by applicable law, not by this section.

21. Indemnification

You agree to indemnify and hold harmless Radiance at Fluhme, Shopify, and our respective affiliates, owners, employees, and service providers from any claims, losses, damages, and reasonable attorneys' fees arising from your breach of these Terms, your violation of any law or third-party right, or your misuse of this website.

This includes third-party claims arising out of your access to, or inability to access, this website or any website linked from it, including a claim that something you read, viewed, or downloaded from it is obscene, offensive, defamatory, or infringing. We will notify you of any such claim and may control its defense at your expense. We will not settle a claim that imposes a non-monetary obligation on you without your consent, which you will not unreasonably withhold.

22. Governing law and venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws rules. Any dispute arising out of these Terms or your use of this website will be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to the jurisdiction of those courts.

23. Changes to these Terms

We may update these Terms at any time by posting a revised version on this page with a new "Last updated" date. Material changes take effect as described in the notice we provide. Continuing to use the site after changes are posted means you accept them.

24. General

Severability. If any part of these Terms is found unenforceable, that part is limited or removed to the minimum extent necessary and the rest stays in effect.

Waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.

Entire agreement. These Terms are the complete agreement between you and us regarding this website and supersede any earlier versions. Your informed consent documents and any signed membership or package agreement govern the care and programs they cover.

Assignment. You may not assign or transfer these Terms. We may assign them without notice.

Survival. Sections covering our content, feedback, disclaimers, limitation of liability, indemnification, governing law, and general terms survive any termination.

Headings. Headings are for convenience only and do not affect interpretation.
